Section 3732 Homicide by Vehicle
Under Section 3732 Homicide by Vehicle (a), any person who recklessly or with gross negligence causes the death of another human being while violating any law of this Commonwealth or municipal ordinance applying to operating a motor vehicle or the use of a vehicle, or to the regulation of traffic with the exception of Section 3802 (involving driving under the influence of drugs or alcohol) is guilty of committing the crime of homicide by vehicle. Homicide by vehicle in Pennsylvania is a third degree felony when such violation causes death.
Under Title 18, Crimes and Offenses, Chapter 11, § 1101, a third degree felony is punishable by $15,000 in fines, and under Title 18, Chapter 11, § 1103 a third degree felony is punishable by a maximum of seven years as determined by the court.
As you can see, being involved in an auto accident that causes death to another person, whether it's a friend or family member in your own vehicle, or an occupant of the other vehicle has serious, life-altering repercussions. According to the National Highway Traffic Safety Administration (NHTSA), in 2011 32,367 people died in motor vehicle collisions in the United States, which was actually the lowest number since 1949. In 2011, there were 3,331 fatalities involving distracted driving, a 1.9% increase from 2010. According to the NHTSA, in 2011 the state of Pennsylvania had 1,286 fatalities, a -2.9% decrease from 2010.
